Terms of Service

These Terms of Service (the "Terms") are an agreement between you and The Personalization Hub LLC, doing business as The Personalization Hub™ ("we", "us" or "our"). They apply when you use this website, place an order online, or buy from our kiosk at Gloucester Premium Outlets.

By using the website or placing an order, you agree to these Terms, our Returns & Refunds policy and our Privacy Policy, which are part of these Terms. If you do not agree, please do not use the website or place an order.

You must be at least 18 years old, or have the permission and supervision of a parent or guardian, to place an order.

When you submit an order through the website you are making an offer to buy. We accept your order when we confirm it by email or at the kiosk. Your order confirmation and order reference are not a guarantee that we can produce the item.

We may decline or cancel an order, including after confirmation, if the item is unavailable, if the content you submit is not allowed under section 5, if there is an obvious error in the price or description, or if we suspect fraud. If we cancel an order you have paid for, we will refund the full amount you paid.

Prices are in U.S. dollars and may change at any time, but a change will not affect an order we have already accepted. Applicable sales tax is added at checkout or at the kiosk. If a price on the website is clearly wrong because of a typing or technical error, we will contact you before producing the item and you may cancel at no charge.

For shipped orders, we confirm the shipping cost with you by email before we ship. You may accept the shipping cost, switch to kiosk pickup, or cancel before personalization starts.

You are responsible for the accuracy of everything you ask us to personalize, including spelling, names, dates, numbers, punctuation and the choice of photo. We produce items exactly as submitted or approved by you. We may contact you about anything that looks like a mistake, but we are not required to catch errors and we will not change your content without your confirmation.

Previews on the website are illustrations to help you visualize your item. They are approximate and are not a guarantee of the exact appearance of the finished product.

When you upload a photo, logo or design, or enter text (together, "Your Content"), you confirm that:

• you own Your Content or have every permission needed to have it reproduced on a product, including from the photographer or copyright owner;
• you have the permission of every identifiable person shown, or of their parent or guardian if they are a minor; and
• Your Content does not infringe anyone's copyright, trademark, right of publicity or privacy, and is not unlawful.

You keep ownership of Your Content. You give us a limited, non-exclusive, royalty-free license to use, copy and adapt Your Content only to produce, deliver and support your order. We will not use Your Content for advertising or display it publicly unless you give us separate written permission. We delete uploaded photos as described in our Privacy Policy.

We may refuse any content that we reasonably believe is unlawful, infringing, obscene, hateful, harassing, violent, sexualizes minors, uses a company's name or logo without authorization, or is otherwise inappropriate. Logos and trademarks for corporate orders must be supplied by, or with the written authorization of, the owner.

You agree to indemnify and hold us harmless from claims, losses and reasonable legal fees arising from Your Content or from your breach of this section.

We describe and photograph our products as accurately as we can. Product photos on this website show examples of each style; your item will carry your own personalization. Colors, sizes and finishes may vary slightly, and natural materials such as crystal and wood have small variations that are part of their character.

Pickup times you choose online are requests for when you would like to collect your order. Most orders are ready at the time you choose, but busy periods, equipment issues or the complexity of an item can cause delays. We will contact you if your order will not be ready.

We hold finished orders for 60 days after the chosen pickup date, as described in our Returns & Refunds policy. Delivery dates given for shipped orders are estimates from the carrier.

Because every item is personalized, all sales are final. Our Returns & Refunds policy explains when we remake an item or issue a refund, and how to report a problem within 7 days.

Free custom Acrylic Keychain offer: one free custom Acrylic Keychain is included with each order whose product subtotal, before tax and shipping, is $100 or more. One keychain per order. The keychain has no cash value, cannot be exchanged, and is personalized with text you provide. Orders cannot be combined to reach the threshold.

We may change or end a promotion at any time. A change will not affect an order we accepted before the change.

The website, including its text, photos, video, graphics, logos and design, belongs to us or our licensors and is protected by copyright and trademark law. You may use it to browse and place orders for your own personal use.

You agree not to: copy or scrape the website or its content; interfere with its security or operation; attempt to access accounts or areas you are not authorized to use; submit false orders or information; or use the website for any unlawful purpose.

Our products come with the remake-or-refund remedy described in our Returns & Refunds policy for our errors, manufacturing defects and shipping damage. Apart from that remedy and any warranty that New Jersey law does not allow us to exclude, the website and our products are provided "as is", and we make no other express warranties.

To the fullest extent permitted by New Jersey law, our total liability to you for any claim relating to an order is limited to the amount you paid for that order, and we are not liable for indirect, incidental or consequential losses, such as lost profits or emotional distress, that result from a delayed, defective or incorrectly personalized item.

This section does not limit our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or willful misconduct, or for any other liability that New Jersey law does not allow to be limited.

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of laws rules. If you have a concern, please contact us first; most issues can be resolved quickly. Any lawsuit relating to these Terms or your order must be brought in the state courts located in Camden County, New Jersey, and you and we consent to their jurisdiction. Either of us may bring a claim in small claims court if it qualifies.

We may update these Terms from time to time. The version posted when you place an order applies to that order. The effective date at the top of this page shows when they last changed.

If any part of these Terms is found to be unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the policies they reference, are the entire agreement between you and us about their subject.
